Important: These Website Terms govern use of the Nalo website, online ordering journey and NaloNode platform access. Paid subscriptions and installed equipment are additionally governed by the applicable Subscriber Agreement and Customer Schedule.

1. About Nalo

NALO MOBILITY FINTECH (Pty) Ltd, registration number 2026/009830/07, trading as Nalo, provides vehicle tracking, telematics, fleet management information services and related mobility support services. The website is available at https://nalonode.com.

2. Acceptance

By using this website, creating an account, requesting a quotation, placing an order or using the NaloNode platform, you agree to these Terms and the policies linked from them. If you conclude a separate written agreement with Nalo, that agreement prevails to the extent of a direct conflict.

3. Electronic contracting

An electronic order is not finally accepted until Nalo confirms acceptance, activates the applicable service, or otherwise communicates acceptance. Before an online order is finally placed, the customer must be given a reasonable opportunity to review the transaction, correct errors and withdraw from the transaction. Electronic communications, records and signatures may be used to conclude and administer agreements to the extent permitted by South African law.

4. Services

Nalo services may include tracking and telematics, trip and route information, driver identification, alerts, vehicle and asset reporting, maintenance-related information, fuel oversight, field service support, workshop management and other subscribed fleet functions. The exact service scope is the scope shown in the accepted quotation, order confirmation, Subscriber Agreement or Customer Schedule.

Tracking and telematics depend on satellite visibility, mobile networks, device condition, vehicle power, installation quality and other infrastructure outside Nalo's exclusive control. Jamming, tampering, signal loss, network outages or environmental conditions can interrupt or delay data. Tracking, alerts or recovery coordination do not constitute an insurance policy or a guarantee that theft, loss, damage or an incident will be prevented or that a vehicle will be recovered.

5. Accounts and authorised users

You must provide accurate account information and keep credentials confidential. A business customer is responsible for users it authorises and for configuring access rights appropriate to their roles. You must promptly notify Nalo of suspected unauthorised account access.

6. Lawful use of tracking and driver data

A customer may use Nalo services only for vehicles, assets and persons it is lawfully entitled to monitor. Business customers are responsible for ensuring that employees, drivers, contractors and other affected persons receive all notices and consents required by law and internal policy before monitoring begins. Nalo may suspend access where it reasonably believes the service is being used unlawfully, deceptively or to endanger another person.

7. Prohibited conduct

You may not interfere with the platform, bypass security controls, introduce malicious code, scrape the service at scale without permission, reverse engineer protected components except where law expressly permits, use the service for unlawful surveillance, impersonate another person, or access information for which you are not authorised.

8. Equipment

Unless an accepted Customer Schedule expressly records an outright sale, tracking, telematics and related equipment supplied as part of a subscription remains the property of Nalo. Customers must take reasonable care of Nalo-owned equipment and may not sell, pledge, materially alter, remove or permit unauthorised tampering with it. Return, removal and replacement obligations are dealt with in the Subscriber Agreement and the Refund, Cancellation and Returns Policy.

9. Pricing, VAT and payment

Prices, once-off activation charges, installation charges, recurring fees and other amounts are those disclosed at checkout or in the accepted quotation or Customer Schedule. Nalo's standard once-off activation fee is R350 unless a written offer lawfully provides otherwise. Where VAT is chargeable, the amount payable must be disclosed in accordance with South African tax and consumer law. Payment is generally made monthly in advance by debit order, EFT or another approved payment method, subject to the Customer Schedule.

10. Consumer fixed-term agreements

Where section 14 of the Consumer Protection Act applies, a consumer fixed-term agreement may be cancelled on 20 business days' written or other recorded notice, subject only to amounts lawfully due and a reasonable cancellation charge determined in accordance with applicable law. A consumer fixed-term agreement should not exceed 24 months unless the longer period is expressly agreed and Nalo can demonstrate the financial benefit of the longer term to that consumer, or another lawful exception applies.

11. Intellectual property

The website, platform, software, interfaces, trademarks, layouts, reports and Nalo-created content are protected by applicable intellectual-property law. Nalo grants subscribed users a limited, non-exclusive, non-transferable right to use the service for lawful internal purposes during the subscription term. No ownership in Nalo intellectual property is transferred.

12. Customer content

You retain rights in information lawfully uploaded by you. You grant Nalo the limited rights reasonably necessary to host, process, transmit, back up and display that information in order to provide, secure and support the service and meet legal obligations.

13. Third-party services

Some functions may depend on mobile networks, mapping services, installers, recovery providers, payment processors, merchants or other third parties. Their own terms may apply to their services. Nalo remains responsible for its own legal obligations and does not exclude liability that cannot lawfully be excluded.

14. Availability and changes

Nalo may perform maintenance, security updates and service improvements. Material changes that adversely affect an active paid subscription will be dealt with in accordance with the applicable agreement and consumer law. Nalo may change website content and non-contractual descriptions from time to time.

15. Liability

Nothing in these Terms excludes or limits liability that may not lawfully be excluded, including rights under the Consumer Protection Act. To the extent permitted by law, Nalo is not liable for losses caused solely by circumstances beyond its reasonable control, including communications-network failure, satellite interruption, unlawful jamming, customer tampering, incorrect customer-supplied information or unauthorised use of customer credentials. Any limitation in a signed agreement must be interpreted consistently with mandatory consumer law.

16. Privacy

Personal information is processed in accordance with the Privacy Policy. Corporate customers must also comply with their own POPIA obligations when using NaloNode to process driver, employee or third-party personal information.

17. Suspension and termination

Nalo may suspend access where reasonably necessary for security, unlawful use, material breach or non-payment, after giving any notice required by law or the applicable agreement. Termination does not extinguish amounts already lawfully due, ownership rights, confidentiality obligations or other provisions intended to survive termination.

18. Complaints and disputes

Complaints should first be sent to support@nalonode.com with the account or transaction reference and supporting information. Consumer rights to approach the National Consumer Commission, National Consumer Tribunal, a competent ombud where applicable, or a court are not limited by these Terms.

19. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any contractual jurisdiction clause is subject to mandatory consumer-protection rights and the jurisdiction of competent South African courts and statutory regulators.

This document must be read with any signed Subscriber Agreement, Customer Schedule or Business Fleet Schedule. Where applicable law gives a person greater protection than this document, the law prevails.
